Terms of Service for Swavoti Social

Effective Date: June 30, 2025

1. Agreement to Terms

By creating an account and using the Swavoti Social mobile application and its related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Swavoti South Africa (pty) ltd ("we," "us," or "our"), concerning your access to and use of the Service.

2. User Accounts and Responsibilities

a. Eligibility: You must be at least 13 years old (or any higher minimum age required in your country) to create an account and use the Service.

b. Account Registration: To access most features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are required to verify your email address to activate your account.

c. Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

d. User Conduct: You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links, and other content or materials (collectively, "Content") that you submit, post, or display on or via the Service.

3. User-Generated Content

a. Your Rights: You retain full ownership of the Content you post to Swavoti Social.

b. License Grant to Swavoti: By posting Content on or through the Service, you grant us a non-exclusive, royalty-free, worldwide, sublicensable, transferable license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, and publicly display such Content. This license is for the limited purpose of operating, promoting, and improving the Service and to develop new ones. This license ends when you delete your Content or your account, subject to our data retention policies.

c. Content Responsibility: You represent and warrant that: (i) you own the Content posted by you on or through the Service or otherwise have the right to grant the rights and licenses set forth in these Terms; (ii) the posting and use of your Content on or through the Service does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; and (iii) you agree to pay for all royalties, fees, and any other monies owed by reason of Content you post on or through the Service.

4. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Posting violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic, or sexually suggestive photos or other content.
  • Using the Service for any illegal or unauthorized purpose.
  • Interfering with or disrupting the Service or servers or networks connected to the Service.
  • Attempting to impersonate another user or person.
  • Creating accounts with the Service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler, or scraper.
  • Harassing, abusing, harming, or intimidating another user.
  • Posting private or confidential information of any third party without their consent.

Violation of these Terms may, in our sole discretion, result in termination of your Swavoti Social account.

5. Intellectual Property

All rights, title, and interest in and to the Service (excluding Content provided by users) are and will remain the exclusive property of Swavoti South Africa (pty) ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both South Africa and foreign countries. Nothing in the Terms gives you a right to use the Swavoti name or any of the Swavoti trademarks, logos, domain names, and other distinctive brand features.

6. Monetization and Verification

a. Monetization: The Service may offer features allowing verified users to earn money from their Content ("Monetization Features"). Your use of Monetization Features is subject to separate terms and conditions, which you must agree to before use. We reserve the right to determine eligibility for Monetization Features.

b. Verification: We offer an account verification service ("Verified Badge") to help authenticate the accounts of public figures, creators, and brands. We reserve the right to grant or revoke the Verified Badge at our sole discretion and to charge a fee for this service.

7. Third-Party Services

Our Service integrates with or may contain links to third-party websites or services that are not owned or controlled by Swavoti South Africa (pty) ltd, such as ImgBB and Thumbsnap for media hosting. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

You can terminate your account at any time by following the instructions within the app or by using our data deletion request form as outlined in our Privacy Policy.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, SWAVOTI SOUTH AFRICA (PTY) LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the courts of Pretoria, Gauteng, South Africa.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
